Terms & Conditions

These Terms & Conditions ("Terms") cover your use of The Unspoken. This is the site at theunspoken.io (the "Service"). You agree to these Terms when you make an account. You also agree when you use the Service.

1. The Service

The Unspoken helps you think about your relationships. You can use it on your own or as a couple. You get AI-generated reports, KPIs and action plans. KPIs are measures of progress. Facilitators run anonymous surveys for couples and groups. They get results for the whole group to help them plan training. System administrators set up and run the Service.

2. Accounts

Give correct details and keep your sign-in details safe. You are responsible for what happens in your account. An account belongs to the person named at signup. A couple account belongs to the two linked partners. A facilitator account belongs to the person named at signup. This must be the facilitator or an authorised team member.

3. Acceptable use

• Do not collect data in ways that break the law. Get proper consent from your partner or participants.
• Do not attempt to deanonymise, re-identify, or reverse-engineer respondent data.
• Do not use the Service to harass, defraud, coerce, or harm anyone.
• Do not upload malware, scrape data, or try to stop the Service working.

4. Subscriptions and payment

You pay for your chosen plan in advance. Plans are per-session, monthly, or annual. See prices on our pricing page. If a direct debit fails, we will try it again. If it fails again, we will delete your records and reports. We do this seven (7) days after the retry date. We will email you before we delete them.

5. Cancellation and refunds

You can cancel at any time in your account settings. Your plan ends at the end of your current billing period. Except where required by law, fees paid are non-refundable. We delete the linked records and reports seven (7) days after subscription expiry.

6. Facilitator responsibilities

Facilitators are the data controllers for their session answers. You must tell participants that the survey is anonymous. Make sure they freely consent to take part. You must follow the privacy laws that apply where you work.

7. Individual and couple responsibilities

You are responsible for the details you enter. This applies to individual and couple users. You also choose how to share your results. In a couple account, both partners consent to combining their answers. We use them for shared reports and action plans. Both partners can see these.

8. Intellectual property

The Unspoken or its licensors own the Service. This includes its content, brand and software. You keep the rights to content you submit. You grant us a licence to process that content. We use it to provide the Service.

9. AI-generated reports and action plans

AI models create reports, KPIs, tips and action plans. They are for reflection and informational purposes only. They do not constitute professional counselling, medical, legal, or financial advice.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, The Unspoken shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim shall not exceed the fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

12. Suspension and termination

We may suspend or terminate accounts that break these Terms. We may also do this to protect the Service or other users from risk.

13. Changes

We may change these Terms. Using the Service after a change takes effect constitutes acceptance. This means you agree to the new Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory local law provides otherwise.
