These Terms & Conditions ("Terms") govern your use of The Unspoken platform at theunspoken.io (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

The Unspoken enables facilitators to run anonymous reflection surveys for married and courting couples and to receive AI-generated training insights based on aggregated responses.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. Accounts are for the individual facilitator or authorised team member named at signup.

3. Acceptable use

• Do not use the Service to collect data unlawfully or without proper consent from your participants.
• Do not attempt to deanonymise, re-identify, or reverse-engineer respondent data.
• Do not misuse the Service to harass, defraud, or harm any person.
• Do not upload malware, scrape, or attempt to disrupt the Service.

4. Subscriptions and payment

Paid plans are billed in advance according to the plan you select (per-session, monthly, or annual). Prices are shown on our pricing page. Failed direct debits will be retried; if the retry fails, your records and reports will be deleted seven (7) days after the retry date, with prior email notice.

5. Cancellation and refunds

You may cancel at any time from your account settings. Cancellations take effect at the end of the current billing period. Except where required by law, fees paid are non-refundable. Seven (7) days after subscription expiry, associated records and reports are automatically deleted.

6. Facilitator responsibilities

Facilitators are the data controllers for respondent submissions collected during their sessions. You must ensure your participants understand the survey is anonymous and comply with all applicable privacy laws in your jurisdiction.

7. Intellectual property

The Service, its content, brand, and software are owned by The Unspoken or its licensors. You retain rights to content you submit but grant us a licence to process it for the purposes of providing the Service.

8. AI-generated reports

Reports and recommendations are generated by AI models and are for informational and training use only. They do not constitute professional counselling, medical, legal, or financial advice.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, The Unspoken shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim shall not exceed the fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

11. Suspension and termination

We may suspend or terminate accounts that breach these Terms or that create risk for the Service or other users.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory local law provides otherwise.
